Legislation

The Sullivans Cove Waterfront Authority Act 2004 was passed by the Tasmanian Parliament in November 2004.

The Sullivans Cove Waterfront Authority was proclaimed on 4 April 2005. Under the Sullivans Cove Waterfront Authority Act 2004, the Authority has the following functions:

  • to identify and, where appropriate, maintain and enhance the cultural, historic, social and economic components of the planning area;
  • to facilitate the use or development of land in the planning area;
  • to assess and approve or refuse the use or development of land in the planning area; and
  • such other functions as may be imposed on it by this Act or any other Act.

The Authority’s enabling legislation, the Sullivans Cove Waterfront Authority Act 2004 , creates responsibilities for the Authority under other existing legislation. These include statutory planning, building and plumbing responsibilities as well as organisational obligations under the following Acts:

When assessing and determining planning applications, the Authority is bound by the Sullivans Cove Planning Scheme 1997 and must consider the Hobart Waterfront Urban Design Framework 2004
